Regulatory compliance for residential rentals in the Netherlands

-The purpose of this page it to establish adherence to the laws, regulations and guidelines relevant to renting out serviced accommodation in the Netherlands.

-Some changes in the regulations surrounding the rental of residential properties in the Netherlands have been imposed or will likely will be imposed in the coming 6 months.

-The below is a summary and an explanation on how CCR will be handeling them.

Middle market rent price control
The Netherlands will likely set a rent cap for 'mid-range' properties starting 2024 based on a point system.
-The proposed bill is pending government approval which is expected in October 2023.
-This will likely include all properties below 187 points and may restrict monthly rental income for those properties to around 1.100,00 euros. If you wish for your property point status to be calculated then please email: james@citycentreretreat.com
-Extra point relevance will be given for things such as the energy label and outdoor spaces (pending final details).
-If/when the rule passes, CCR will be dividing the monthly revenue stated in the agreements with the tenant into the following six categories: rent, furnishings, utilities, maintenance, support and service.
-Pending final details, and in an extreme case, CCR may be required to secure a seperate service agreement to go along with the tenancy agreemennt.

Tenancy agreements
The Netherlands will likely be abolishing the 'Temporary Rental Agreements'. Some exceptions to specific tenants will be given (pending confirmation) but they are suggesting this could be students, residents renovating their own homes and people moving to the Netherlands for work.
In circumstances where CCR can not use a temporaty agreement we will;

-Use an indefinite rental agreement.
-Inform owners before as part of the candidate approval stage, that the indefinite agreement would be used.

Our indeifinate agreement will still allow tenants to terminate at any time with one calendar months notice.
CCR services, maintenance and support costs
As always, CCR never charge any additional fees to the tenant nor the landlord. This includes all services, maintenance and support.

Good landlordship act
Effective 1st July 2023, the government seeks to prevent exploitation of tenants by setting out new obligations.

Fortunately, together, we currently comply and exceede all of these obligations.
Tennant rules and regulations
1. Utilities usuage - Gas, water and electricty is included in the monthly revenue payment up to a caped reasonable amount stated in the agreement.

-This cap primarily incentivises tenants to be cautious and use energy responsibly. This includes turning things off when they are not needed and not using the property for commercial purposes.
-This cap allows for reasonable use.
-Tenants will be warned when they exceed the cap and given time to reduce their usage.

2. Deposits - All tenants must pay a deposit equal to one month's rent.
We produce a full property inspection report with signed photos during check-in and check-out.
-If a basic clean is required after checkout (up to 150 euros), then City Centre Retreat will return 100% of the deposit within 48 hours.
-Deductions from the deposit can only be used if there is damage or it is left un-reasonably dirty.
-Normal wear and tear can not be used to deduct from the deposit.
-It's very uncommon to deduct anything from the deposit, but we use it to encourage tenants to look after the property and leave it reasonably clean.
-If things get damaged, or we need to arrange a deep clean, tenants should let us know before checkout so we can make preparations to resolve matters and promptly return the deposit minus the costs.

3. Respectful to neighbors - Tennants are expected to be respectful to neighbours. Although a city, Amsterdam has a town vibe that many of the locals like to keep. If the accommodation has a communal entrance then we ask tenants to keep the noice down while entering and exiting the building.

4. House Rules - VVE (housing association) rules will be communicated prior or during checkin. As a standard, parties, pets (without prior consent), smoking and any commercial use are strictly forbidden inside the property.
